Attempt to stop auction of Rossmund Golf Course fails

An attempt to stop a judicial auction of the Rossmund Golf Course near Swakopmund on Wednesday has failed in the Windhoek High Court.

An application by the close corporation Rossmund Golf Course CC to stop the Development Bank of Namibia (DBN) and the deputy sheriff for the district of Swakopmund from proceeding with a sale of the golf course, owned by the close corporation, failed with a finding by judge Gabriel Komboni that they have not met the requirements to have their case heard on an urgent basis.

Komboni struck the application from the court roll on Wednesday morning.

The Rossmund Golf Course, comprising 53.6 hectares of land, is due to be sold at an auction by the deputy sheriff for the district of Swakopmund at 12h00 on Wednesday.

The auction was arranged as a result of a default judgement for the payment of N$19.9 million that the DBN obtained against the close corporation in the Windhoek High Court in April 2022.

In the application heard by Komboni on Wednesday, the court was informed that Bank Windhoek has in the meantime filed an application to have Rossmund Golf Course wound up. The bank is alleging that the close corporation, as surety for the close corporation Premier Construction CC, owes it N$101.5 million and is unable to pay its debts.
