Speeding drivers risk claim rejection: Financial Ombud Scheme

The National Financial Ombud Scheme has warned that South African motorists who exceed speed limits risk having their insurance claims rejected

The industry regulator has noted that while standard policies cover negligence, crashes resulting from high speeds are classified as a breach of the “due care” clause and drive up premiums. 

The alert comes as South Africa continues to grapple with the highest road fatality rate on the continent

This has prompted insurers to tighten enforcement on speed-related claims. 

The scheme’s Darpana Harkison, “When it comes to the distinction between negligence and recklessness, recklessness requires an element of foreseeability in the sense that I am driving at 140 kilometres per hour on the road, knowing full well that I am insured and knowing full well that I can possibly cause an accident driving at that speed.”
