Constitutional Lawyer Musa Kika has mourned Justice Minister Ziyambi Ziyambi’s decision to use the law as a weapon and undermine Zimbabwe’s fight for democracy
This follows the Cabinet’s approval of amendments to Zimbabwe’s Constitution that will, among other things, totally end Presidential elections.
Information Minister Jenfan Muswere said the amendment (Constitutional Amendment No. 3 Bill) will strengthen constitutional governance and promote political stability.
“The Constitutional Amendment No. 3 Bill, 2026 proposes a series of legal reforms to strengthen constitutional governance, clarify institutional roles, promote political stability, and enhance the efficiency of the State architecture,” he said after 2026’s first sitting.
“The Bill forms part of Zimbabwe’s continuing legal evolution and seeks to adhere to the spirit of the Constitution, refine and mordenise certain provisions in response to governance experience, developmental imperatives, and comparative constitutional practice.”
Ziyambi’s amendments, which were presented to President Emmerson Mnangagwa before being discussed in Cabinet on Tuesday, are hinged on Zanu PF’s Resolution No. 1 that seeks to illegally extend his term in office to 2030.
It is at the centre of factional fights within the ruling party, where many others believe Mnangagwa has run his race.
According to Kika, who now heads the Institute for Human Rights and Development in Africa (IHRDA), Ziyambi lent his skill to men and women of evil intent.

“The law is an ass. It has no intrinsic values, nor does it have any inherent moral content. It’s a tool; a weapon. And there are mercenaries, men and women ready, willing and able to lend service to other men and women of wicked intent and evil schemes,” he said.
“These can argue anything, the absurd even. They write laws, they interpret laws and they enforce laws under the guise of constitutional office and just ‘doing my job’. They are undertakers; enablers; conspirators; accomplices.
“Then there is the other side. The law can be engineered into a tool for justice; for the fair regulation of the interaction and affairs of a people, for the collective progress of a society. And there are men and women, ready, willing and able to lend service to these ideals.
“Why would a person choose the former variety of the law and legal operation? Justice Minister Ziyambi Ziyambi chose that route when he presented himself as a willing legal mercenary to shepherd on his boss’s behalf, a coterie of proposed amendments to the Constitution under Constitution of Zimbabwe Amendment No. 3 Bill of 2026, that go above and beyond the treacherous resolution 1 at the 2024 ZANU PF National People’s Conference.”
If passed, the proposed changes will ensure Mnangagwa’s dream is achieved and Parliament’s life is extended by a further two years.
Added the former Zimbabwe Human Rights NGO Forum director: “They now want to change the electoral system: remove popular participation in electing the president and place the responsibility on parliament – a borrowed concept from electoral systems that operate at a totally different wavelength to ours.
“They want a 7-year term for the president and parliament – a total of 14 years if one does two terms. They are incentivising parliamentarians to vote for an extended presidency for selfish reasons.”
