(AURN News) — A federal judge in California found that the Trump administration’s investigations into suspected noncitizen voting likely violate the Voting Rights Act by intimidating Americans who help others vote. U.S. District Judge Araceli Martínez-Olguín ordered restrictions on Department of Homeland Security election investigations in nine states, including Georgia and Pennsylvania.
Her Oct. 21 ruling describes unreliable records, outdated citizenship information and rushed reviews that risk sweeping U.S. citizens into investigations. The court also cited federal agents, field interviews and a publicity campaign featuring arrests as contributing to fear around voter outreach.
The restrictions cover certain election-related field operations involving people agents know, suspect or reasonably should know or suspect are U.S. citizens.
There’s a critical time detail, though. The judge delayed the order’s effective date until 5 p.m. Friday, Oct. 23, giving the government time to appeal.
The restrictions are scheduled to remain in effect through the close of polls on Election Day, Nov. 3, unless the court orders otherwise.
