Father referred to Family Court after partner leaves with children

By Breaking Belize News Staff (HP): An Orange Walk District man who reported that his common-law wife left their home with her two children following an argument has been referred by police to the Family Court, the proper venue for arranging access and visitation, in a case that illustrates how such family matters are handled under Belizean law.

According to the Belize Police Department, a 30-year-old machine operator of San Estevan Village visited the Orange Walk Police Station on Monday, August 3, 2026, to make the report.

He told police that on Sunday, August 2, at about 7:00 a.m., he got into a verbal confrontation with his common-law wife at their home. According to his account, she shouted at him and insulted him, and to avoid further confrontation, he left the house and returned later, but the insults continued. She then packed her personal belongings and left the house along with her two children.

The man stressed to police that at no point did he chase her from the house, stating that she left of her own free will. His account represents his side of the matter, and the woman’s perspective does not form part of the police report.

Police recorded a statement for future reference, and because the man expressed that he wants to see his child, he was referred to the clerk of court to apply for access and visitation.

Leaving a relationship is not a criminal matter, and police cannot compel any adult to remain in or return to a household. What the law does provide is a clear path for parents: statements can be recorded to document events, and questions of access, visitation, custody, and maintenance belong to the Family Court, where both parents are heard and the children’s best interests govern the outcome.

For any parent navigating a separation, the referral in this case is the roadmap: the clerk of court is the starting point, and the Family Court is where a parent’s time with their child is formally secured.
