JUST IN | NPA declines to prosecute Emmarentia road rage shooter
The National Prosecuting Authority has decided not to prosecute the man arrested in connection with a fatal road rage shooting in Emmarentia.
The National Prosecuting Authority (NPA) has decided not to prosecute, at this stage, the 58-year-old man arrested in connection with a fatal road rage shooting in Emmarentia, Johannesburg.
The suspect had been expected to appear in the Johannesburg Magistrate’s Court on Tuesday on charges of murder and attempted murder following the death of Faisal ul Rehman, 48, and the shooting of his wife, Tehseen Rehman.
However, NPA spokesperson Magaboke Mohlatlole confirmed that the matter will not proceed for now.
“After careful consideration of the evidence of the alleged road rage incident… the NPA has decided not to prosecute the matter pending further investigation,” Mohlatlole told reporters outside the Johannesburg Magistrate’s Court.
Self-defence claim central to decision
The suspect’s legal team submitted representations arguing that he acted in self-defence.
In his statement, the man alleged that the incident escalated after a collision, claiming he was verbally abused and physically assaulted by the couple.
He further alleged that Tehseen produced a firearm and discharged it before handing it to her husband, who also fired shots.
He maintains that he returned fire in private defence, fatally wounding Rehman and injuring Tehseen.
Police investigation continues
According to South African Police Service (SAPS) spokesperson Dimakatso Nevhuhulwi, the shooting followed a minor fender-bender on Barry Hertzog Avenue that escalated into gunfire.
Police have opened cases of murder and attempted murder, with investigations ongoing.
Family seeks justice
The decision not to prosecute at this stage has dealt a blow to the Rehman family, who have indicated their intention to pursue justice.
A video of the incident, which has circulated widely on social media, shows the aftermath of the shooting, including the victim’s children at the scene.
Authorities have urged motorists to remain calm and avoid confrontations on the road, warning of the potentially fatal consequences of road rage incidents.
