A closely watched civil-rights trial over allegations that Tesla allowed systemic discrimination against Black workers at its flagship California factory is set to begin Monday.
The California Civil Rights Department filed the lawsuit in 2022, accusing the electric-vehicle manufacturer of failing to prevent or stop widespread racial harassment at its Fremont assembly plant. The state alleges that Black employees were subjected to racial slurs and racist graffiti and were treated unfairly in pay and promotion opportunities.
Tesla has denied wrongdoing in related litigation and has said it maintains policies against workplace harassment. The company and its attorneys did not respond to Reuters’ requests for comment ahead of Monday’s trial.
Lawyers for Tesla and the state agency are scheduled to present the case in Oakland before California Superior Court Judge Peter Borkon. The bench trial—meaning the judge, rather than a jury, will decide the case—is expected to continue through Oct. 30.
The proceeding could become an important test of corporate responsibility for discrimination complaints in large industrial workplaces. California law does not impose the same caps on discrimination damages that apply under federal law, increasing the potential consequences if the state proves its claims.
The case is separate from lawsuits brought by individual workers and a federal complaint filed by the U.S. Equal Employment Opportunity Commission. Several Black employees have accused Tesla of permitting racially hostile conditions at the Fremont plant, while Tesla has contested unresolved claims and settled some individual cases without publicly disclosed terms.
No ruling has been issued in the state’s case. The trial will determine whether the agency can prove its allegations and what remedies, if any, should be imposed.
