High commissioner sues IPC member for N$250 000 over WhatsApp audio defamation claim

Namibian high commissioner to Ghana Ndiyakupi Nghituwamata has filed a N$250 000 defamation lawsuit in the High Court against former Outapi constituency councillor and Independent Patriots for Change member Fillemon Shikwambi over an alleged defamatory WhatsApp audio recording.

According to court documents dated 12 November 2025, Nghituwamata alleges that Shikwambi authored and circulated an audio message on WhatsApp on or about 22 September 2025 containing false and malicious statements that damaged her reputation.

In her particulars of claim, Nghituwamata alleges that Shikwambi has suggested she was appointed as executive director in the Ministry of Agriculture, Fisheries, Water and Land Reform through nepotism and political influence linked to Swapo secretary general Sophia Shaningwa, rather than on merit.

The lawsuit further states that the audio implies her father was a “puppet” of the South African apartheid regime.

A translated transcript attached to the court papers alleges that Nghituwamata benefited from financial support linked to the late northern businessman David Sheehama and favoured certain individuals in employment opportunities within government structures.

Nghituwamata argues that the statements portray her as corrupt, dishonest, unqualified for public office and linked to a family associated with the apartheid administration.

“The above false and defamatory innuendos, insinuations, suggestions and statements were intended by the defendant and were understood by persons who acquired knowledge thereof to mean that the plaintiff is corrupt, dishonest, lacks integrity and ethics and is unqualified and undeserving of the position of executive director,” the court papers read.

The diplomat, who was appointed high commissioner to Ghana last year, denies the allegations and maintains that she was appointed strictly on merit.

She states that her late father, Mauno Indongo, a former Outapi businessman, had legitimate liberation struggle credentials.

According to the lawsuit, the circulation of the audio recording severely damaged Nghituwamata’s dignity, reputation and standing in the eyes of the Namibian public.

She is seeking N$250 000 in damages, interest at 20% per annum from the date of judgement until final payment, legal costs and an order compelling Shikwambi to issue an unconditional retraction and apology.

However, in his plea before court, Shikwambi denied that the statements were defamatory.

He argued that the remarks constituted political expression made within a political context and should be protected under the right to freedom of speech and expression.

“The statement made by the defendant was a political expression of views and was made in the context of politics,” Shikwambi stated in his plea.
