By Breaking Belize News Staff: A 42-year-old Guatemalan construction worker is behind bars tonight after pleading guilty to an immigration offense, days after he was detained in connection with an alleged stabbing incident involving his nephew.
Elmer Ramirez Hernandez appeared in the Belize City Magistrate’s Court on Wednesday, where he was arraigned before a Senior Magistrate on a single charge of failure to produce a valid permit upon demand to an Immigration Officer.
Hernandez pleaded guilty, telling the court, “Guilty because I am illegal.”
He was fined $1,000 plus $5 cost of court, which he was ordered to pay forthwith. In default, he will serve six months in prison.
The matter arose after Ladyville Police detained Hernandez while investigating a stabbing incident that reportedly occurred on Mother’s Day, Sunday, May 10, at a construction site. Police say Hernandez was accused of stabbing his nephew, but the victim has chosen not to press criminal charges.
Hernandez was later handed over to the Belize City Immigration Department, where checks revealed that he entered Belize on April 5, 2026. However, he was unable to produce valid identification or immigration documents when requested.
Immigration officials also checked the MIDAS migration database but found no record for Hernandez. The Guatemalan Embassy was contacted and confirmed his age, date of birth, and occupation.
Although Hernandez was treated as a first-time offender for the immigration offense, court records showed that he had a previous conviction in Belize dating back 17 years for keeping a firearm without a gun license. The court record also indicated that a fine from that previous conviction remains outstanding, though Hernandez claimed he had served time in default of payment.
The Immigration Department applied for a removal order, which was granted by the court. Hernandez is expected to be removed from Belize after his fines are paid or after he serves the prison term in default.
